Welcome to Clubily, the platform designed to transform the management of your sports club. By using our products and services (hereinafter, the "Services"), you agree to be bound by these terms. Please read them carefully.

1. Nature of the Service and Acceptance.

Clubily provides software services and mobile applications oriented to the comprehensive management of sports entities. The access and use of our platform implies that you have read and accept these Conditions of Use, as well as our Privacy Policy.

2. Access and Account Management.

To enjoy the full experience of Clubily, it is necessary to create a user account.

•Account Responsibility: You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.

•Security: In case of detecting unauthorized use, you must change your password immediately and notify us at support@clubily.es.

•Minimum Age: According to our Privacy Policy and Spanish regulations (LOPD-GDD), access to Clubily is reserved for those over 14 years old. Minors under 14 require the prior and explicit consent of their legal representatives for the processing of their data.

3. Intellectual Property and Licenses.

a. Our Property.

Clubily is the exclusive owner of all intellectual property rights over the software, design, and trademarks of the Services. We grant you a personal, global, non-exclusive, and limited license to use our software solely for the purpose of enjoying the Services provided.

b. Your Content.

You retain all intellectual property rights over the information and files you upload to the platform. However, by using Clubily, you grant us a license to host, reproduce, and adapt such content with the sole purpose of operating, improving, and promoting the Services. This license remains active while your account is in force.

4. Conduct Rules and Proper Use.

As a user, you agree not to perform the following actions:

•Interfere with the technical operation of the platform or attempt to access by unauthorized methods.

•Use the Services to harass, threaten, or impersonate third parties.

•Post defamatory, obscene content or content that violates the intellectual property rights of other users.

•Extract source code or perform reverse engineering of our applications.

5. Privacy and Information Security.

The processing of your personal data is governed by our Privacy Policy, which complies with the GDPR (EU) and the LOPD-GDD (Spain).

•Encryption: We guarantee the security of your communications through SSL certificates.

•Roles: Clubily acts as Data Controller for account data but acts as Data Processor (technical provider) regarding additional data managed by sports organizations (clubs).

6. Warranties and Limitation of Liability.

Clubily strives to offer a high-quality service. However, Clubily takes into account the following:

•Availability: We do not guarantee that the service will be uninterrupted or error-free at all times.

•Third-party content: Clubily is not responsible for the content posted by other users or sports entities.

•Legal Limit: To the extent permitted by law, our total liability for any claim will be limited to the amount you have paid for the use of the Services.

7. Modification and Termination.

We may update these conditions or the functions of our Services to adapt them to legal changes or technical improvements.

•Notification: We will inform you about significant changes.

•Termination of service: You can stop using Clubily at any time. If we decide to cancel a service, we will give you reasonable notice so that you can recover your information.

8. Applicable Legislation and Jurisdiction.

Since Clubily is based in Boadilla del Monte (Madrid), these conditions are governed by Spanish legislation. Any dispute arising in relation to these terms will be resolved before the competent courts of Madrid, Spain.
